1. Acceptance

These Terms of Use (the “Terms”) form a legally binding agreement between you and Zypharoxz Travel Guides Ltd. (“Zypharoxz,” “we,” “us,” or “our”) regarding your access to and use of our website, including any pages available under the routes listed in our footer and navigation, and any content made available through them (collectively, the “Service”).

By accessing, browsing, or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

Minimum age: The Service is not directed to individuals under the age of 16. If you are under 16, you may not use the Service. If you are 16 or 17, you represent that you have permission from a parent or legal guardian to use the Service and that they have reviewed these Terms with you.

2. Service description

Zypharoxz provides informational content about travel in Canada. Our content includes city travel guides, road trip inspiration, seasonal destination ideas, nature attraction overviews, weekend getaway outlines, and travel packing tips. The Service is intended to help users plan travel in a practical way by organizing information into readable guides and checklists.

Limitations: We are not a travel agency and we do not sell travel products, tickets, or reservations through the Service. We do not guarantee that any attraction, park, road, service provider, or experience described in our content will be available on specific dates. Information such as hours, closures, prices, accessibility, and weather-related conditions can change. You are responsible for verifying details with official sources and providers.

3. User obligations

You agree to use the Service only for lawful purposes and in a way that does not infringe the rights of others or restrict their use of the Service. In particular, you agree that you will:

• Provide accurate information if you contact us through our contact page, and not misrepresent your identity.
• Use the Service in a manner consistent with applicable laws and regulations, including privacy and intellectual property laws.

5. Prohibited activities

The Service is provided on an “as is” and “as available” basis. To the maximum extent permitted by applicable law, Zypharoxz disclaims all warranties and conditions, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

We do not warrant that the Service will be uninterrupted, error-free, secure, or free of harmful components. We do not warrant the accuracy, completeness, or reliability of any content, including travel information that may become outdated due to changes by third parties such as parks, municipalities, and service providers.

7. Limitation of liability

To the maximum extent permitted by law, Zypharoxz and its directors, officers, employees, contractors, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, goodwill, or other intangible losses arising out of or related to your use of (or inability to use) the Service.

To the maximum extent permitted by law, Zypharoxz’s total liability for any claim arising from or related to the Service will be limited to the amount you paid to Zypharoxz for the Service in the 12 months immediately preceding the event giving rise to the claim, or 100 EUR, whichever is lower.

Some jurisdictions do not allow certain limitations of liability. In such cases, our liability will be limited to the minimum extent permitted by law.

8. Indemnification

You agree to indemnify, defend, and hold harmless Zypharoxz and its directors, officers, employees, contractors, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of the Service; (b) your violation of these Terms; or (c) your violation of any rights of another person or entity.

9. Third-party links

The Service may reference third-party websites or resources for convenience, such as official park pages or transportation providers. Zypharoxz does not control and is not responsible for the content, products, services, or practices of those third-party sites. Your use of third-party sites is at your own risk and subject to their terms and policies.

11. Governing law

You agree that the courts located in Toronto, Ontario will have exclusive jurisdiction over any disputes not subject to informal resolution as described below, and you submit to the personal jurisdiction of those courts.

12. Dispute resolution

Informal resolution: Before filing a claim, you agree to contact us and provide a brief written description of the dispute and your contact information. We will attempt to resolve the dispute informally within 30 days of receiving your notice.

If the dispute is not resolved within 30 days, either party may pursue a claim in the courts described in the Governing Law section. Nothing in this section prevents either party from seeking urgent injunctive or equitable relief in the event of unauthorized access, misuse of intellectual property, or security-related harm.

13. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, if we reasonably believe you have violated these Terms or engaged in conduct that may harm the Service, other users, or Zypharoxz.

Upon termination, the license granted to you to use the Service will end immediately. Sections that by their nature should survive termination will survive, including Intellectual Property, Disclaimer of Warranties, Limitation of Liability, Indemnification, Governing Law, and Dispute Resolution.

14. Modifications

We may update these Terms from time to time to reflect changes to the Service, legal requirements, or business practices. Updated Terms will be posted on this page and will become effective 14 days after posting. Continued use of the Service after the effective date constitutes acceptance of the revised Terms.

If changes are significant, we will provide notice on the homepage. If you do not agree to the updated Terms, you must stop using the Service.
